GENERAL CONTRACT/DISCLAIMER
My Property
This Agreement outlines the terms and conditions for any services provided by My Property. By engaging with our services, the client ("Client," "you," or "your") agrees to the following terms:
1. PAYMENT TERMS
1.1. All invoices are due upon receipt unless otherwise agreed upon in writing. 1.2. Late payments will be subject to a 1% service charge per month on overdue accounts. 1.3. Deposits or progress payments may be required based on the scope of work. 1.4. If stated, a non-refundable deposit is required for bookings and material securement upon approval of the quote. 1.5. Non-payment may result in suspension or termination of services without notice. 1.6. All payments are to be made in Canadian Dollars (CAD) unless otherwise specified.
2. TAX TERMS
2.1. All applicable taxes, including but not limited to GST/HST, will be applied to invoices as required by Canadian law. 2.2. The Client is responsible for ensuring compliance with all tax obligations related to the services rendered. 2.3. If the Client is tax-exempt, a valid exemption certificate must be provided before invoicing.
3. SERVICE TERMS
3.1. Services will be performed according to the agreed-upon scope of work outlined in a separate agreement or contract. 3.2. My Property reserves the right to refuse service to any Client at its discretion. 3.3. Any timelines provided are estimates and may be subject to reasonable delays. 3.4. The Client agrees to provide all necessary information and cooperation required to complete the services.
4. CHANGES & MODIFICATIONS
4.1. Any changes to the scope of work must be agreed upon in writing and may result in additional charges. 4.2. My Property reserves the right to modify services, pricing, or terms at any time, with reasonable notice provided to the Client. 4.3. If a Client requests modifications after work has commenced, additional costs and time adjustments may apply. 4.4. The final invoice is subject to change in order to reflect the accurate amount of time spent on the job.
5. GENERAL DISCLAIMER
5.1. My Property provides services "as is" and makes no warranties, expressed or implied, regarding the outcomes or results of any services provided. 5.2. My Property is not liable for any indirect, incidental, or consequential damages arising from the use of its services. 5.3. My Property is not responsible for any slips, falls, collisions, injuries, or damage that may occur on the property before, during, or after the work performed by our team. 5.4. The Client agrees to indemnify and hold harmless the Company, its employees, and contractors from any claims, liabilities, or damages related to the services provided. 5.5. The Company is not responsible for delays or failures caused by circumstances beyond its reasonable control, including but not limited to acts of God, government restrictions, labor disputes, or technical failures. 5.6. My Property is fully licensed, insured, and covered by WCB in the event that an injury to one of our team members should occur. 5.7. Any disputes, claims, or concerns should first be addressed directly with the Company to seek an amicable resolution. If an agreement cannot be reached, alternative dispute resolution methods such as mediation or arbitration may be pursued before legal action is considered.
By engaging with My Property, the Client acknowledges that they have read, understood, and agreed to the terms outlined above.
